A. H-1B Lottery Process with Money-Back Guarantee Service

My H-1B visa is approved. When can I start working?
A lottery is held each year for the H-1B visa, followed by the application process. This visa is valid for the next fiscal year. Since the fiscal year in the U.S. begins on October 1st, the earliest date you can start working with an H-1B visa is also October 1st.
How long is the H-1B visa valid for?
The H-1B visa is typically granted for up to 6 years, divided into two 3-year periods.
In some cases, you can extend your H-1B visa beyond the 6-year limit in 1-year or 3-year increments if:
- Your PERM application has been pending for at least 365 days,
- Your EB immigration petition (I-140) has been pending for at least 365 days, or
- Your EB immigration petition is approved, but you can’t apply for a Green Card because your category isn’t available in the visa bulletin.
The company I’m currently working for under OPT wants to sponsor me for an H-1B. What should I do when my OPT period ends?
If an H-1B application has been submitted to USCIS while your OPT work authorization is still valid, your work authorization is automatically extended until the H-1B is approved, even if your OPT period ends. This allows you to transition to H-1B status without any interruption in your employment.
